- Claiming Against Deceased Estates
A person to whom the deceased has a moral duty to support may make a claim to alter the interests in a Will. The application should be made within 6 months of the Grant of Probate. If later then leave of the Court is required.
A person may be upset if the deceased lacked the mental capacity at the time he or she made the Will or if the deceased was unduly influenced.
